Leading indicators rise 0.9 percent in October (AP)

WASHINGTON ? A gauge of future economic activity rose at solid pace in October, offering hope that the economy may see stronger growth in coming months.

The Conference Board reported Friday that its index of leading economic indicators rose 0.9 percent last month, significantly faster than the revised 0.1 percent rise in September and the 0.3 percent increase in August.

The economy, after growing at an anemic pace of just 0.9 percent in the first six months of the year, grew at a 2.5 percent rate in the July-September quarter. Some analysts are looking for even stronger growth in the current October-December quarter.

But even the most optimistic forecasters are not predicting growth will rebound to levels that would make a significant dent in the unemployment rate, which has been stuck around 9 percent for the past two years.

The October rebound in the leading index reflected positive contributions from building permits, the spread between short-term and long-term interest rates, a rising stock market and a slightly better employment reading.

Economists said the strong October gain in the leading index and other positive reports recently had at least eased fears that the economy would be in danger of slipping into a recession.

Conference Board economist Ken Goldstein said that the latest leading indicators report was pointing "to continued growth this winter, possibly even gaining a little momentum by spring."

Conservation body agrees to protect silky sharks

(AP) ? Delegates at an international conservation meeting agreed Saturday on a measure mandating that silky sharks accidentally caught in fishing gear be released back into the sea alive, marine advocacy groups said.

The 48-member International Commission for the Conservation of Atlantic Tunas (ICCAT), however ? ending a weeklong meeting in Istanbul ? failed to reach consensus on other threatened shark species, the groups said.

Conservationists also said more could have been done to save swordfish from decline in the Mediterranean while the World Wildlife Fund said steps adopted to preserve bluefin tuna remained insufficient.

While establishing protections for the silky sharks, ICCAT ? which manages tuna in the Atlantic and Mediterranean as well as species, like sharks, that have traditionally been accidental catches for tuna fishermen ? made an exception for coastal developing countries, where the predators can continue to be caught for local consumption of their meat and not for the trade of their fins.

The sharks, named after the silk-like smooth texture of their skins, are among shark species most vulnerable to decline, threatened by the international trade in shark fins due to an increasing demand mainly in Asia for shark fin soup.

Marine advocacy groups, including Oceana and The Pew Environment Group, welcomed the measure saying it would help overturn the silky sharks' decline, though they also said they had hoped for more.

"Cutting the nets to free sharks when they are caught, will give a large number of them a real chance to survive," Susan Lieberman, director of international Policy at the Pew Environment Group, told The Associated Press by telephone. "The measure is an important step."

The group estimates that up to 1.5 million silky sharks are traded annually for their fins, and that up to 40 percent can survive if they are returned to the sea alive.

"It is a very good step forward in protecting one the most vulnerable species," said Elizabeth Griffin Wilson, senior manager of marine wildlife at Oceana.

The advocacy groups however, expressed disappointment that no measure had been taken to protect porbeagle sharks, or to establish catch limits for blue and shortfin mako sharks.

"It's another year that they could not reach a decision for the porbeagle shark," Lieberman said of the species which continue to be fished in Canadian waters.

Other measures adopted by ICCAT in Istanbul include a requirement for members to submit data on the species they catch or risk losing their right to catch those species in the following year. Oceana has said failure to report on catches were preventing conservationists from adequately assessing the impact of fisheries on threatened species.

On swordfish, ICCAT agreed on a set measures, including setting a minimum size for catch, but Oceana said "more should be done."

The conservation body also agreed on a system to electronically track data on bluefin tuna to better control fraudulent practices and help keep fishing closer to the legal quotas. A Pew report has found that in 2010, the amount of Mediterranean bluefin tuna traded surpassed the ICCAT quota by 141 percent.

The WWF said, however, the measure did not include data on fish transfers to tuna fattening farms in the Mediterranean arguing that this allowed for the "laundering of illegal, unregulated and unreported catches." The group called for a more "reliable" data assessment or for the total ban of tuna farming in the Mediterranean.

In a move to fight illegal fishing, ICCAT members also decided that vessels measuring 12 meters or more ? instead of the previous 20 meters or more ? would be inspected on arrival to port, Pew said.

Android Market Lousy With Malware, Says Juniper (NewsFactor)

As the number of applications available in Google's Android Market has soared, users are paying a price: More and more malware.

That's the claim of information technology and network products giant Juniper Networks, whose Global Threat Center believes the easy process for posting apps has led to a whopping 472 percent increase in malware samples since July 2011.

All Too Easy

"These days, it seems all you need is a developer account, that is relatively easy to anonymize, pay $25 and you can post your applications," wrote Juniper on its threat center blog, noting that the lack of upfront review leaves the world's largest smartphone community browsing through poorly defined, unscreened apps that will only be removed after the fact if malware is reported or detected by Google.

"This approach has led to major increases in research into and discovery of vulnerabilities within the Android platform as the delivery mechanisms of mobile malware," said Juniper, which published its Malicious Mobile Threats Report for 2010 and 2011 in July. That report, showing a 400 percent increase in Android malware, looked at increasingly sophisticated attacks, including "Myournet/Droid Dream, Tap Snake and Geinimi as well as the pirating of the 'Walk and Text' application, new threat vectors for mobile cybercrime, and the potential for exploitation and misuse of mobile devices and data."

The report puts something of a damper on Google's boast at the launch of Google Music in Los Angeles Wednesday that more than 200 million Android-based phones have been activated, with more than half of that growth in the past six months, as companies like Samsung, HTC, LG and Motorola trot out increasingly powerful devices via all four top carriers, as well as smaller ones like MetroPCS and Virgin Mobile.

Google's press office did not respond to our inquiry via email for a comment about the report in time for publication.

All The Rage

Last March, both comScore and Nielsen reported that Android had surpassed Research In Motion's BlackBerry and Apple's iOS to become the most popular operating system in the U.S.

ABI Research reported last month that 44 percent of all mobile application downloads in the second quarter were Android, compared with Apple's 31 percent.

Analyst Alex Spektor of Strategy Analytics said the open-source Android was not fundamentally less secure than its competitors.

"Desktop variants of Linux are typically quite secure and suffer from much less malware trouble than does Microsoft Windows," said Spektor. "Rather, the amount of malware in the Android Market is a result of the open nature of the store itself. Unlike Apple, whose App Store staff review each submission, Google does not pre-screen apps."

But he added, "Of course, bad apps can be always removed after being discovered."

So who's responsible for the malware?

"The Global Threat Center believes it's the same actors who originally wrote malicious code for the legacy platforms of Symbian and older versions of Windows Mobile," Juniper wrote. "They shifted to Android given its gains in significant market share when compared with these legacy platforms."

What you need to know from this week on ?The Ultimate Fighter?

We're moving ever closer to the finale of the last season of "The Ultimate Fighter" to air on Spike before it moves to the Fox family of networks. Hopefully, that doesn't mean the last of the coaches challenges, which happens tonight. Huzzah! Read on for spoilers and recaps.

The show started out on a sweet note. Dustin Pague passed the same homeless man on the street during the drive from the house to the training center every day, so he decided to put together a bag of food, drinks and an encouraging note and handed it off to the man. The van barely slowed down long enough for him to do it, but kudos to Pague for thinking outside his own world of training.

Jason "Mayhem" Miller stopped by the house for a BBQ, and is somehow devolved into a competition of bug-eating. I don't even ... I can't even ... Why? Pague ate a bunch of bugs, so he won, I guess?

Oh, but there's a real competition this week! COACHES CHALLENGE! Nothing perks up a season of TUF like the coaches' challenge. Remember Brock Lesnar losing at football? Jens Pulver becoming a pro ping pong player? Forest Griffin dominating Quinton Jackson in basketball? Exactly.

This time around, it's air hockey. As usual, the winning coach gets $10,000 and each of his team members gets $1,000. Both Miller and Bisping say that they haven't played in years, and it's obvious by their poor technique.

Bisping scores first, second and through six until Miller finally scores. Miller is terrible, and Bisping easily took the first two games. To the surprise of no one, Bisping started talking crap, and Mayhem took the third one. The last game was tight, but Bisping took it. He jumped on the table to celebrate, but then fell off the table.

The semifinal fights continue tonight, with the winner headed to the finale. Dillashaw has an obvious wrestling advantage, while Pague is much more comfortable standing up. This isn't a big trash talk-filled bout. Dillashaw is the last bantamweight to be standing for Team Bisping, which he says proves how much better he is than his opponents.

Semifinal bout: Dustin Pague vs. T.J. Dillashaw in three-round bout

Round 1: Dillashaw landed solid strikes and then got his first takedown in the first minute. He couldn't pass guard, but he did a good job of holding off Pague's submission attempts. Dillashaw landed several big elbows and completely controlled him on the ground until the final 30 seconds. Pague pushed him off, landed a big knee, but didn't have time to get a rhythm going from his feet.

Round 2: Again, Dillashaw started with an easy takedown, but was much closer to the cage. He had to move to side control and spin Pague around slowly to get him away from the fence. For the rest of the round, Dillashaw kept Pague on his back. It wasn't exciting, but it was effective.

Between rounds, both corners realized that Pague had to get a knockout or a submission for a win, because the judges cards would be on Dillashaw's side.

Round 3: Dillashaw had a harder time getting the takedown this time, but guess what? He still did it. He also landed some nasty strikes that opened a cut on Pague's face. Aside from the blood, the second round looked exactly like the third.

Dillashaw took the decision and moved on to the finals with a score of 30-26, 30-27, 30-26. He very kindly consoled Pague after the loss.

Court says backers can defend gay marriage measure (AP)

SAN FRANCISCO ? The sponsors of ballot propositions can step in to defend their initiatives from legal challenges if the governor and attorney general refuse to do so, California's highest court said Thursday in a precedent-setting ruling that could prove pivotal to the future of the state's same-sex marriage ban and its notoriously vigorous citizens' initiative process.

Responding to a question from a federal appeals court that is considering the constitutionality of the state's voter-approved gay marriage ban, the California Supreme Court said the lawmaking power granted to citizens under the state constitution doesn't end once propositions have been approved or rejected by voters.

"We conclude that California law authorizes the official proponents, under such circumstances, to appear in the proceeding to assert the state's interest in the initiative's validity and to appeal a judgment invalidating the measure," the unanimous ruling written by Chief Justice Tani Cantil-Sakauye states.

In the 61-page opinion, the seven justices said denying ballot proposition backers a seat at the table would effectively grant the governor and attorney general veto power over initiatives with which they disagreed, a situation the justices said would undermine the law-making powers California gave voters in 1911.

"Neither the governor, the attorney general, nor any other executive or legislative official has the authority to veto or invalidate an initiative measure that has been approved by the voters," the decision said. "It would exalt form over substance to interpret California law in a manner that would permit these public officials to indirectly achieve such a result by denying the official initiative proponents the authority to step in to assert the state's interest ..."

A three-judge panel of the 9th U.S. Circuit Court of Appeals asked the state court in January to clarify who is eligible to fight for voter-approved initiatives in court when state officials opt not to. The panel said the question was unsettled under both federal and California law, but central to its deliberations in the ongoing same-sex marriage skirmish because if the backers of the 2008 initiative known as Proposition 8 lacked legal standing, it would have to dismiss the case.

The coalition of religious and conservative groups that qualified Proposition 8 for the ballot and successfully campaigned for its passage have asked the 9th Circuit to reverse a federal trial judge's ruling in August 2010 striking down the measure as a violation of gay Californians' civil rights. Both former Gov. Arnold Schwarzenegger and Gov. Jerry Brown, in his previous role as state attorney general, took the unusual step of refusing to appeal the decision.

The appeals court panel now must decide whether to accept the court's guidance and if so, how to apply it to Proposition 8. The state court's word, while expected to carry substantial weight since it involves a state Constitutional matter, is non-binding on the federal court.

But if the 9th Circuit does accept the Supreme Court's interpretation, it would clear the way for the appeals court to analyze the substance of the appeal. The ban's supporters on Thursday cheered the likelihood of that happening now that the state court has weighed in.

"We are delighted that the Supreme Court has clearly reaffirmed our right, as the official proponents of Prop 8, to defend over seven million Californians who amended their own State Constitution to restore traditional marriage," Protect Marriage General Counsel Andy Pugno said. "This victory is an enormous boost for Proposition 8 as well as the integrity of the initiative process itself."

Lawyers for the two gay couples who successfully sued to overturn the ban in the lower court had argued that if the ban's backers did not have the right to appeal, the trial judge's decision would stand and same-sex marriages would be legal in California for the first time since Proposition 8 passed three years ago.

After the Supreme Court ruling was issued, the couples' high-powered lawyers said they still felt confident the ban ultimately would be struck down by the 9th Circuit and possibly reach the U.S. Supreme Court.

"We are very anxious to move forward on the merits," former U.S. Solicitor General Ted Olson said.

The ruling establishes a state precedent that could be used in other ballot initiative cases the attorney general or governor decline to defend. Instances are rare of state officials refusing to appeal rulings that are adverse to voter-approved laws, but they have come up in California every couple decades or so.

Civil rights groups criticized the Supreme Court's expansive view of the initiative process, predicting it would put minorities at a political disadvantage.

"Allowing the Prop 8 proponents to have special rights in court may open the floodgates to wealthy special interests to do the same," said Courage Campaign chairman Rick Jacobs, whose group champions progressive causes in California. "The judges of the 9th Circuit must determine if people who had enough money to buy a ballot measure that calls for people to vote on each other's rights should have special rights in federal court."
